1. Acceptance of Terms

By accessing or using FitMagic ("the App"), you agree to be bound by these Terms of Service. If you do not agree, do not use the App.

2. Fitness & Health Disclaimer

THE APP IS FOR INFORMATIONAL AND EDUCATIONAL PURPOSES ONLY. IT IS NOT MEDICAL ADVICE. Exercise involves risk of injury. By using the App you acknowledge that: • You are voluntarily participating in physical activities and assume all risks associated with those activities, including but not limited to muscle strains, joint injuries, cardiovascular events, and death. • Tai Run Enterprises LLC, its officers, employees, contractors, and agents are NOT liable for any injury, illness, death, loss, or damage of any kind arising from your use of the App or any workout, program, or recommendation provided by the App. • You should consult a qualified physician or healthcare provider before starting any exercise program, especially if you have any pre-existing medical condition, injury, or are pregnant. • AI-generated workout plans and recommendations are not a substitute for professional fitness instruction. Always use proper form and technique.

3. No Medical Advice

Nothing in the App constitutes medical advice, diagnosis, or treatment. Calorie estimates, nutritional information, and recovery scores are estimates only and may not reflect your individual circumstances. Never disregard professional medical advice or delay seeking it based on information in the App.

4. Supplement Tracking

Supplement tracking and AI-generated correlational observations are for informational and personal record-keeping purposes only. Correlations between logged supplement intake and performance metrics are observational — they do not establish causation and are not medical, clinical, or nutritional advice. Never start, stop, or modify a supplement regimen based on app observations. Always consult a qualified healthcare provider.

If you track prescription medications or controlled substances (including hormone therapies such as testosterone or estradiol), continue following your prescribing provider's instructions. FitMagic's tracking does not replace medical supervision. Abrupt changes to prescribed medications can be dangerous — consult your provider before any changes.

Peptides and Unregulated Substances: Many peptides (including BPC-157 and TB-500) are not approved by the FDA for human use and may not be legal to purchase or use in your jurisdiction. FitMagic does not endorse, recommend, or validate any unregulated substance. If you choose to log such substances, you do so at your own risk. FitMagic provides no warranty regarding the safety, purity, efficacy, or legality of any peptide or research chemical. If you experience adverse health effects, contact emergency services or a healthcare provider immediately — do not rely on this app.

5. User Responsibilities

You are solely responsible for: • Ensuring you are physically capable of performing any exercise before attempting it • Using proper equipment and technique • Stopping exercise immediately if you experience pain, dizziness, shortness of breath, or any other concerning symptom • The accuracy of any health data you enter into the App

6. Account & Access

You must be at least 18 years old to create an account independently. Users between 13–17 may use the App only with verifiable parental consent. The App is not available to children under 13 without a parent or guardian account. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account.

7. Subscription & Billing

FitMagic is a paid subscription service. By subscribing you authorize recurring charges to your payment method. Subscriptions auto-renew unless cancelled before the renewal date. Refunds are at our discretion and subject to applicable law. A 30-day free trial is available for new subscribers. A valid payment method is required to start the trial. You will be charged at the end of the trial period unless you cancel.

8. Intellectual Property

All content in the App — including workout programs, exercise descriptions, AI-generated plans, and software — is owned by Tai Run Enterprises LLC or its licensors. You may not reproduce, distribute, or create derivative works without prior written consent.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FITMAGIC LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING PERSONAL INJURY, PROPERTY DAMAGE, LOSS OF DATA, LOSS OF REVENUE, OR ANY OTHER LOSS ARISING FROM YOUR USE OF THE APP. IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID FOR THE APP IN THE 12 MONTHS PRECEDING THE CLAIM.

10. Indemnification

You agree to indemnify and hold harmless Tai Run Enterprises LLC and its affiliates from any claims, damages, losses, and expenses (including legal fees) arising from your use of the App, your violation of these Terms, or your violation of any third-party rights.

11. Changes to Terms

We may update these Terms at any time. Continued use of the App after changes constitutes acceptance of the new Terms. We will notify you of material changes via email or in-app notice.

12. Governing Law

These Terms are governed by the laws of the State of Florida. Any disputes shall be resolved in the courts of Osceola County, Florida.
